NOTARIAL FEES AND DOCUMENTS WHEN CONFESSING A REAL ESTATE TRANSACTION

The necessary documents for the transfer of ownership of real estate are the following:

For the buyer:

•ID

• Decl. Under Art. 25 for citizenship and civil status / validity 6 months /

• Decl. Under Art. 4 for declaring the origin of the money / validity 6 months /

• In the event that the buyer is unable to attend the transaction in person, he is legally entitled to authorize a third party to represent him with a power of attorney.

For the seller:

•ID

• Property ownership document

• Tax assessment certificate

• Sketch of the property / issued in the last six months /

• Decl. Under Art. 25 for citizenship and marital status - for married couples one for each of the spouses / validity 6 months /

• Decl. Under Art. 264 for outstanding enforceable obligations for taxes, duties and compulsory social security contributions

• In the case of a property with a registered real right of use, in order to carry out the sale, the user should waive the established real right - this is done with a declaration of waiver of the right of use. In case the user has died, an extract from the death certificate shall be submitted.

• When the property is inherited - Certificate of heirs, death certificate of the testator, will.

• In case the seller (s) is divorced, a court decision for the divorce.

• Certificate of encumbrances on the property

• In the event that the seller is unable to attend the transaction in person, he is legally entitled to authorize a third party to represent him by power of attorney.

• When transferring a property in a newly built building - relevant documents from the builder / investor - building permit, architectural design and distribution of areas, permission for use – Act- 16 and others.

• If the seller is a legal entity - a decision of the sole owner of the capital to sell the property

The due fees are calculated on the material interest in the amount of the sale price of the real estate, but not lower than the amount of the tax assessment for the property.

• Notary fee - calculated according to the Tariff for notary fees on material interest

• Fee for entry of the notary deed in the Property Register at the Registry Agency in the amount of 0.1% of material interest.

• Local tax - from 0.1% to 3%. The amount of tax for each municipality is determined by the municipal council

The sums are generally paid to the notary, the latter making the entry of the notarial deed and the payment of the due fees.
